Terms & Conditions of Service

E.L.S and E•L•S are a trading names of Elevated Luxury Studio Pty Ltd ABN 54 688 878 408.

These Terms & Conditions ("Terms") govern your access to and use of Elevated Luxury Studio ("E.L.S", "E•L•S" referred to in these terms as “we”, “us”, and “our”), our website www.elevatedluxurystudio.com and our social media channels (our "Site" or "Sites"), and the purchase of our products and our associated services (collectively hereinafter referred to as, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. Please read them carefully before making a purchase. If you do not agree, please refrain from using our Site.

Please take the time to carefully read the terms of use before placing any orders with us that are applicable to your use and enjoyment of this Site and the content made available to you via this Site and our social media channels, as well as your purchase of any products from our online store. These Terms, together with our Privacy Policy, apply to all Site visitors, subscribers, customers and other users of our Site (“user”, “you” and “your”). We recommend you keep a copy of the Terms of Service for future reference.

In particular, we wish to draw your attention to our policies relating to the terms of purchase within the Terms & Conditions and our Privacy Policy. We may amend the Terms from time to time. Please read the Terms and check back often. If you do not agree to any change to the Terms then you must immediately stop using the Site. Any changes made after you have placed an order will not affect that order unless we are required to make the change by law.

1. Acceptance of Terms

By accessing or using our Services, you acknowledge that you have read, understood and agree to be bound by these Terms. E.L.S reserves the right to update or modify these Terms at any time without prior notice. Continued use of the Services after such changes are posted constitutes acceptance of the revised Terms.

You may not use our products or services for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). Any breach or violation of any of the Terms will result in an immediate termination of Services.

2. Eligibility

To access and use our Services, including making purchases on our Site, you must:

Be at least 18 years of age or the legal age of majority in your jurisdiction. By using this Site, you represent and warrant that you meet this requirement. You also confirm that you have given us consent to allow any of your minor dependents to use this Site.
Have the legal authority and capacity to enter into binding contracts.
Provide accurate, current, and complete personal and payment information.
Not use our Services for any illegal or unauthorized purpose, nor violate any applicable laws in your jurisdiction (including but not limited to copyright or intellectual property laws).
Use our Services solely for personal or gift use. Commercial resale, reproduction, or redistribution is strictly prohibited.

We reserve the right to refuse or cancel any order, restrict shipping to certain regions, limit the quantity of items purchased per person, household, or per order and to decline transactions that, in our sole discretion, appear suspicious or unauthorized.

Merchandise sold via Elevated Luxury Studio Pty Ltd (“E.L.S”) is available exclusively to individuals who can lawfully enter into and form contracts in accordance with the laws of Australia.

By placing an order, you confirm that:

You are providing accurate personal details, including your real name, current address, phone number and email address.
The payment details you provide are valid, correct and correspond to you as the authorized cardholder.
You are authorized to charge the credit/debit card submitted with your order for the full amount of the purchase.

The Site is only available to individuals who meet the E.L.S eligibility criteria, have been issued a valid credit or debit card by a bank acceptable to us, and have authorised E.L.S to charge that card for the total purchase amount. Products are sold strictly for personal or gift use and must not be resold, used commercially, or for any other commercial gain. We also reserve the right to restrict the number of units shipped to a single customer or address.

By making an offer to purchase merchandise, you expressly authorise us to perform credit checks and, where necessary, to transmit or obtain your credit card or credit report information (including any updates) from third-party agencies solely for the purpose of authenticating your identity, validating your payment method, obtaining an initial authorisation, and/or processing purchase transactions.

We may also use personal data provided by you to carry out anti-fraud checks. Information collected in this process may be shared with credit reference or fraud prevention agencies, which may retain a record of that data. 3. Registration and Account

To access certain features of our Site, such as placing and tracking orders, managing preferences, or saving wishlist items, you may be required to create an account.

By registering for an E.L.S account, you agree to:

Provide accurate, current, and complete information during registration and at all other times when using the Site.
Keep your account details up to date, including your contact and payment information.
Maintain the confidentiality of your account credentials and restrict access to your account.

We reserve the right to update registration requirements at any time and to suspend or terminate accounts at our sole discretion.

Benefits of Creating an Account

By registering with us, you’ll be able to:

Track your orders and review past purchases.
Request returns or exchanges directly from your account.
Build a customised Wishlist and curated outfit selections to email or print for convenience.
Save sold-out items to your Wishlist and receive restock alerts.
Be notified when new items become available.
Access any available store credit on your account.
Save your shipping details and payment methods for faster checkout.
Manage your account preferences, address book, and communication settings.

To create an account, select SIGN IN, then REGISTER NOW, and complete the required fields. Please choose a unique and secure password. You are responsible for all activity that occurs under your account.

Forgotten Passwords

If you’ve forgotten your password, you can reset it using the Forgot Password function on the Sign In page. For security reasons, passwords will never be sent via email. Should you have any issues with your account, please contact our Customer Care team. For privacy and security, we can only assist the registered account holder. Should any of your registration information change, please notify us immediately at the following email address info@elevatedluxurystudio.com. We may also change registration requirements from time to time.

4. Products and Orders

4.1 Product Descriptions

We make every effort to ensure that all product descriptions, imagery, and pricing listed on our Site are accurate, up to date and reflective of the product as it appears in real life. We strive to display colors and images as precisely as possible; however, we cannot guarantee that your computer or mobile device’s display of colour will be completely accurate. We do not warrant that product descriptions or other content on the Site will be error-free. Product details, availability, and pricing are subject to change without notice at our sole discretion.

4.2 Products or Services

We reserve the right to modify, discontinue or limit the availability of any product or service at any time without notice. We are not liable to you or any third party for any modifications, price change, suspensions, or discontinuations of products or services. Many of our garments are produced in limited quantities and are subject to return or exchange only according to our Shipping & Returns Policy. We reserve the right, but are not obligated, to limit the sale of our products or services to any person, household, region, or jurisdiction on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. We do not warrant that the quality of any product, service, information or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

4.3 Orders and Acceptance

By placing an order on our Site, you confirm and agree that all billing and shipping information provided is valid, accurate and up to date.

Please note that placing an item in your shopping bag does not reserve it, other customers may purchase the item until your payment is successfully processed and the order is confirmed.

All orders are subject to acceptance, availability and confirmation. We reserve the right to refuse or cancel an order for any reason at any time, including (but not limited to):

Product unavailability
Errors or inaccuracies in product or pricing information
Limitations on quantities
Suspected fraud or unauthorised transactions

Pre-Orders and Advance Purchase

E.L.S offers products for sale that are in stock & ready to ship. From time to time, we may offer items via Advance Purchase (Pre-Order), allowing you to secure a style before it becomes available.

If you place a pre-order:

Your payment will be processed at checkout.
Pre-orders will be shipped as soon as stock is received at our distribution center.
Pre-ordered items are allocated in priority to other customers, including those on the waitlist.

Please note:

Delivery dates are estimated and subject to change due to supplier delays or quality checks.
That we may be unable to deliver selected Advance Payment merchandise due to production problems or quality check issues identified when we receive an order into stock. In the rare case we’re unable to fulfil a pre-order, you will be notified via email and refunded in full within 30 days.

You may also register your email address to our mailing list to receive a back-in-stock alert for sold-out items. While we will do our best to notify you within 48 hours of the product becoming available on the Site. Please note that on occasion certain products that are in particularly high demand will sell out during this period.

4.4 Transaction Records

E.L.S will store a record of your purchases and transactions for a minimum of one year, in accordance with our legal obligations and internal policies..

5. Errors, Inaccuracies And Omissions

From time to time, our Site or Services may contain typographical errors, inaccuracies, or omissions including but not limited to product descriptions, pricing, promotions, offers, shipping charges, transit times, and availability.

We reserve the right to correct any such errors, inaccuracies, or omissions and to update or amend information or cancel orders where necessary at any time and without prior notice, including after an order has been submitted.

We are under no obligation to update, amend or clarify any information within the Service or on related websites, including without limitation, pricing information except as required by law. Any specified update or refresh date displayed in the Service or on any related website should not be interpreted as indicating that all information has been modified or updated.

6. Pricing and Payment Policy

6.1 Pricing

All prices are listed in Australian Dollars (AUD), or the applicable local currency displayed for your selected region and are inclusive of Australian Goods and Services Tax (GST), where applicable, unless otherwise indicated. Prices do not include international shipping fees, international duties, import taxes, VAT, customs charges or clearance fees, unless expressly stated at checkout.

Prices displayed on our Site are subject to change without prior notice. The price applicable to your purchase will be the price in effect at the time your order is placed and accepted. We reserve the right to cancel any order and issue a full refund if a product is no longer available, discontinued or if an error in pricing occurs.

Prices may be adjusted from time to time due to fluctuations in exchange rates, supplier costs, or commercial factors. These adjustments may occur without warning.

Promotions and Discount Codes

From time to time, we may offer promotional pricing or discount codes.

Unless otherwise stated:

Only one discount code may be used per order.
Discount codes cannot be combined with any other promotional offers.
Codes may be subject to conditions such as minimum spend thresholds or eligibility criteria.
We reserve the right to cancel or reject any order where promotional terms are not met, for example, where you add more than one discount code to your order.

Discount codes and gift vouchers cannot be redeemed for cash and may not be transferred. Once a promotional item has been purchased at a discounted rate, no price adjustment will be offered should the item be further marked down.

6.2 Payment Methods

We currently accept the following forms of payment:
Credit/Debit Cards (Visa, MasterCard, American Express)
PayPal

All transactions are processed securely at the time of order placement. By submitting your payment, you confirm that you are authorised to use the payment method provided and that the information entered is accurate.

You agree to keep your billing and payment details up to date at all times and authorise E.L.S to charge your selected payment method for the full transaction amount. Where a credit card is used, you warrant that you have the legal authority to use that card. You authorise us to automatically charge the credit card on file for any and all payment balances owed and agree to keep all billing information current at all times. If payment is declined or cannot be processed, your order may be cancelled without notice.

We reserve the right to cancel any order that we reasonably suspect to involve fraud or unauthorised activity.

International Payment Considerations

International orders are shipped from Australia. Unless expressly stated at checkout, prices do not include import duties, taxes, VAT, customs charges, brokerage fees or clearance fees that may apply in the destination country.
International orders may be shipped on a DAP / Delivered At Place basis, meaning the customer is responsible for paying any applicable duties, taxes and customs charges directly to the courier, postal service or customs authority upon delivery.
These charges are determined by the destination country and are outside the control of E.L.S. We recommend contacting your local customs authority for further information before placing an order.
For orders shipped within the United States, local sales tax may be charged at checkout where applicable.
If your payment card is not denominated in the currency displayed at checkout, your card issuer may convert the charge using its own exchange rate on the day of processing. Please note your bank may apply international transaction fees. E.L.S is not liable for any such fees or charges.

6.3 Modifications to the Service and Prices

We reserve the right to adjust prices, discontinue products or modify our Services (or any part or content thereof) at any time, without prior notice. These changes will not affect orders that have already been placed and accepted.

We shall not be liable to you or any third-party for any modification, price change, suspension or discontinuance of the Service.

E.L.S does not offer price adjustments on products purchased during sale, special events or on items that are further or temporarily reduced in price after your purchase is complete. Once an item has been purchased at a discounted sale price, no price adjustment will be offered should the item be further marked down.

7. Acceptance of Your Order

Once you have made your selection and your order has been placed, you will receive an email acknowledging the details of your order. This email is not an acceptance of your order, only a confirmation that we have received it.

Unless you cancel your order, acceptance of your order will be completed upon the packing of your items. The contract between you and E.L.S is formed when we dispatch the goods to you. At that point, you will receive a second email containing tracking details and confirming that your order has been shipped.

The sale contract is therefore concluded in New South Wales, Australia, and the language of the contract is English. Neither our third-party payment processor nor our nominated courier has the authority to accept an order on behalf of E.L.S.

We reserve the right not to accept or to cancel your order if, for example:

We are unable to obtain authorisation for payment;
Shipping restrictions apply to the particular item(s);
The item ordered is out of stock or does not meet our quality control standards and is withdrawn;
You do not meet the eligibility criteria set out in these Terms

We may also refuse to process any transaction for any reason, or refuse service to anyone, at any time at our sole discretion.

We are not liable to you or any third party for:

Withdrawing any merchandise from the Site (whether or not it has been sold);
Removing, screening or editing any materials or content on the Site;
Refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

While every effort is made to ensure pricing and product details on our website are accurate, errors may occasionally occur. If we discover an error in the pricing of a product in your order, we will notify you as soon as possible. We are under no obligation to accept or fulfil an order for a product that was listed and advertised at an incorrect price and reserve the right to cancel such an order even if it has been accepted or is in transit. If you order a product that is priced incorrectly for any reason, we will contact you to inform you that we have not accepted your order and that the relevant part of your order has been cancelled.

If you have already paid for the item, we will refund the full amount as soon as practicable. If the item is in transit, your refund will be processed once the product has been returned to us.

8. Accuracy of Billing and Account Information

We reserve the right to refuse, limit, or cancel any order placed with us at our sole discretion. This may include limitations on quantities purchased per person, per household, or per order. These restrictions may apply to orders placed under the same customer account, using the same credit card, and/or those with the same billing or shipping address.

If we modify or cancel an order, we will make reasonable efforts to notify you via the email address, billing address, or phone number provided at the time of purchase.

We also reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

You agree to provide current, complete, and accurate information for all purchases made via our Site. This includes your account details, billing and shipping information, and payment details.

You are responsible for keeping this information up to date, including your email address and credit card numbers and expiration dates, to ensure we can process your orders and contact you as needed.

9. Payment

Payment can be made using Visa, MasterCard, American Express, PayPal, Apple Pay, or any other payment methods clearly indicated on our Site at the time of checkout. All transactions are processed securely at the time your order is placed.

By submitting a payment, you confirm that the credit or debit card used is either your own or that you have been specifically authorised by the cardholder to use it. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If your payment is declined or cannot be authorised, we are not liable for any delay or nondelivery of your order.

We take reasonable care to keep our Site secure. All card transactions are processed through a secure online payment gateway that encrypts your card details in a protected host environment.

If you are a registered E.L.S customer, we may securely store your credit/debit card details for future transactions. These details are fully encrypted and only used to process transactions initiated by you.

To help ensure that your shopping experience is safe and secure, E.L.S uses Secure Socket Layer (SSL) technology. This encrypts sensitive data such as payment information and protects it during transmission.

While we take reasonable precautions to safeguard your personal and payment information, in the absence of negligence on our part, we cannot be held liable for any loss or damage you may suffer as a result of unauthorised access to data you provide when accessing or purchasing from the Site.

10. Promotion Codes

Promotion codes offered by E.L.S are non-transferable, cannot be exchanged for cash or credit and are valid only for the time period specified at the time of issuance.

Unless explicitly stated otherwise:

Only one promotion code may be used per transaction.
Promotion codes cannot be combined with other discounts, offers, or promotional events.
Codes must be applied at checkout and cannot be applied retroactively to previous purchases.
Each code is subject to specific terms and conditions, which may include eligibility criteria, minimum or maximum spend thresholds, or product exclusions.

We reserve the right to:

Cancel or modify promotion codes at any time without prior notice.
Reject any order where promotional terms are not met or where misuse of a code is suspected.

Promotion codes are issued for personal use only and must not be shared, sold, or distributed publicly without our express written permission.

11. Shipping and Delivery

11.1 Shipping Overview

We ship domestically within Australia and to select international destinations. Shipping options, estimated delivery timeframes, and applicable rates are calculated at checkout and may vary by region. Orders are dispatched from Sydney, Australia, within 1–2 business days of order confirmation (excluding weekends and public holidays).

Shipping details, eligibility for free shipping, and express options are outlined in our Shipping & Returns Policy, which forms an integral part of these Terms.

11.2 Delivery and Risk

Delivery estimates begin from the dispatch date, not the order date. While we aim to meet delivery estimates, delays may occur due to carrier disruptions, customs processing, or events beyond our control.

Ownership and risk of loss or damage to goods pass to you once:
(a) payment has been received in full, and
(b) the goods have been delivered to the address you provided at checkout.

For international orders, you are responsible for any import duties, taxes, or customs fees where applicable, unless stated otherwise at checkout. Where a signature is required upon delivery, you agree that a signature by someone at your nominated delivery address is sufficient proof of delivery and fulfilment.

We are not liable for parcels lost or stolen after confirmed delivery. If you waive signature on delivery or instruct couriers to leave the parcel unattended, you accept full responsibility for the parcel once marked delivered.

12. Returns and Exchanges

Our returns and exchanges policy is governed by the conditions outlined in our Shipping & Returns Policy, which forms part of these Terms and Conditions.

12.1 Returns Eligibility

We accept returns within 14 days of receiving your order, subject to the following:

Items must be unworn, unwashed, and in original condition with tags attached.
Items marked Final Sale are not eligible for return or exchange.
Due to limited production runs, we do not offer exchanges. Instead, we recommend repurchasing the correct item after returning the original.

12.2 How to Return

To initiate a return, you must follow the instructions outlined in our Shipping & Returns Policy. Returns must be approved in advance via our return request process. Unauthorized returns may not be accepted or refunded.

12.3 Refunds

Refunds will be issued to the original payment method once the returned item passes inspection. Original shipping fees are non-refundable. For full details on processing times and eligibility, please refer to our Shipping & Returns Policy.

12.4 International Returns

International customers may return items at their own cost. Duties, taxes, and customs fees are non-refundable. You must clearly mark packages as “RETURNED GOODS” to avoid additional fees. E.L.S is not liable for any returns held at customs due to incorrect declaration.

12.5 Non-E.L.S Returns

We are not responsible for items mistakenly returned to E.L.S that were not purchased from us. These may be disposed of after 30 days if unclaimed, and we reserve the right to charge a handling fee for their return.

13. Intellectual Property Rights

You acknowledge and agree that all intellectual property rights in and to this Site, including but not limited to the content, design, layout, text, graphics, logos, photographs, audio clips, videos, digital downloads, data compilations, software, trademarks, trade names, and the overall “look and feel” are and shall remain the exclusive property of Elevated Luxury Studio Pty Ltd ("E.L.S") or its content suppliers and are protected by applicable intellectual property laws in Australia and internationally.

This includes all HTML code, underlying software, databases, and any other code contained on the Site (“Content”), whether registered or unregistered.

You are granted a limited, non-transferable, non-sublicensable, revocable license to access and use the Site for personal and non-commercial use only. You may not use, reproduce, copy, modify, publish, republish, upload, post, transmit, sell, license, distribute or otherwise exploit any part of the Site or its Content without express prior written consent from E.L.S or the relevant rights holder.

Any unauthorized use of the Site or its Content may constitute a breach of intellectual property and/or contractual rights and may result in legal action. Violators will be prosecuted to the fullest extent permitted by law.

Without limiting the above, you agree not to:

Copy, reproduce, republish or redistribute any portion of the Site or Content for commercial gain;
Use any data mining, scraping, crawling, or similar tools to extract Content;
Mirror or frame any part of the Site on any other website or server without permission.

All rights not expressly granted to you under these Terms are reserved by E.L.S.

14. Prohibited Uses and User Conduct

By accessing or using our Site and Services, you agree not to use the Site, its Content, or any part of our Services for any unlawful, harmful, or abusive purpose. Specifically, you must not:

Use the Site or its content for any purpose that is unlawful or prohibited under these Terms.
Solicit others to perform or participate in unlawful acts.
Violate any applicable international, national, federal, state, provincial, or local laws, regulations, rules, or ordinances.
Infringe upon or violate our intellectual property rights or those of any third party.
Harass, abuse, insult, harm, defame, slander, intimidate, threaten, disparage, or discriminate against any individual or group based on gender, sexual orientation, religion, ethnicity, race, age, nationality, or disability.
Submit false, misleading, or fraudulent information.

15. Disclaimer of Warranties and Limitation of Liability

We make no representations or warranties, express or implied, regarding the operation of our Site or the information, content, materials, products, or services included on or otherwise made available to you through it.

Specifically, we do not warrant that: The use of our Services will be uninterrupted, timely, secure or error-free.
The results obtained from the use of the Services will be accurate, reliable or meet your expectations. Any errors in the Services will be corrected.
The Site, its servers, or emails sent from us are free of viruses, malware, or other harmful components.

To the fullest extent permitted under applicable law, E.L.S and its directors, officers, employees, contractors, suppliers, agents or affiliates shall not be liable for any direct, indirect, incidental, special, consequential, exemplary or punitive damages, including but not limited to lost profits, lost revenue, loss of data, loss of goodwill, business interruption, replacement costs, or any similar damages arising from:

The use of or inability to use the Site or Services.
The purchase or use of any product obtained through the Site.
Any error, omission or delay in the Site’s operation.
The unauthorized access to or alteration of your transmissions or data.
Any content uploaded, posted or otherwise made available via the Site.

This limitation applies whether such liability arises from breach of contract, negligence, tort, strict liability or otherwise, even if we have been advised of the possibility of such damage.

Nothing in these Terms excludes, restricts or modifies any guarantee, condition, warranty, right or remedy which you may have under the Australian Consumer Law or any other applicable legislation and which cannot be excluded, restricted or modified. If any guarantee, condition or warranty is implied into these Terms under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or any other applicable legislation and cannot be excluded, then our liability is limited (where applicable) to the replacement, repair, or resupply of the relevant goods or services, or a refund of the price paid, at our discretion.

16. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable under any applicable law, such provision shall be enforced to the maximum extent permissible, and the remainder of these Terms shall continue in full force and effect.

If any provision is held by a court of competent jurisdiction to be contrary to law, that provision will be replaced or interpreted to best accomplish the original intent, to the extent allowed by law. This determination shall not affect the validity or enforceability of any other remaining provisions.

17. Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify, defend and hold harmless Elevated Luxury Studio Pty Ltd (E.L.S), its parent company, affiliates, subsidiaries, directors, officers, employees, contractors, agents, licensors, service providers, subcontractors, and suppliers from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable legal fees on a full indemnity basis), arising out of or in connection with:

Your breach of these Terms or any documents they incorporate by reference;
Your violation of any law, regulation, or the rights of any third party;
Your use or misuse of our Site, Services, or products;
Any content or materials submitted by you that infringes the intellectual property, privacy, or other rights of any person or entity.

This indemnity survives the termination of these Terms and your use of our Site or Services.

Entry is open to Australian residents aged 18 years or older. To enter, participants must follow @elevatedluxurystudio on Instagram or TikTok, join the Elevated Luxury Studio mailing list via the website and complete any additional entry requirements specified on the promotional post.

The giveaway opens on 20 May 2026 and closes on 27 May 2026 AEST. The winner will be selected at random and contacted via email and/or direct message within seven (7) days of the closing date.
